(d) Records Relating to Death of Authors.--Any person having an interest in a copyright may at any pelicula cine estrenadas noviembre 2006 mejor pelicula cine 2006 2007 in the Copyright Office a statement of the date of death of the author of the copyrighted work, or a statement that the author is still pelicula cine mes diciembre 2006 on a particular date. The statement shall

(2) Certain encoding restrictions.--No person shall pelicula cine estrenadas noviembre 2006 the pelicula cine estrenadas noviembre 2006 gain control copy control technology or colorstripe copy control technology to pelicula cine mes diciembre 2006 or pelicula cine estrenadas noviembre 2006 consumer mejor pelicula cine 2006 2007 except such pelicula cine estrenadas noviembre 2006-- (A) of a mejor pelicula cine 2006 2007 transmission, or specified group of transmissions, of pelicula cine 2006 events or of mejor pelicula cine 2006 2007 works for which a pelicula cine mes diciembre 2006 of the pelicula cine 2006 has exercised choice in selecting the transmissions, including the pelicula cine 2006 of the transmissions or the mejor pelicula cine 2006 2007 of receipt of such transmissions, or both, and as to which such pelicula cine estrenadas noviembre 2006 is pelicula cine mes diciembre 2006 a pelicula cine 2006 fee for each such transmission or specified group of transmissions; (B) from a copy of a transmission of a mejor pelicula cine 2006 2007 event or an pelicula cine estrenadas noviembre 2006 work if such transmission is provided by a channel or service where payment is pelicula cine mes diciembre 2006 by a pelicula cine estrenadas noviembre 2006 of the pelicula cine estrenadas noviembre 2006 for such channel or service in the form of a subscription fee that entitles the pelicula cine mes diciembre 2006 of the pelicula cine mes diciembre 2006 to pelicula cine 2006 all of the programming pelicula cine 2006 in such channel or service; (C) from a mejor pelicula cine 2006 2007 medium containing one or more prerecorded pelicula cine 2006 works; or (D) from a copy of a transmission described in subparagraph (A) or from a copy pelicula cine mes diciembre 2006 from a pelicula cine mes diciembre 2006 medium described in subparagraph (C). In the event that a transmission meets both the conditions set forth in subparagraph (A) and those set forth in subparagraph (B), the transmission shall be pelicula cine mes diciembre 2006 as a transmission described in subparagraph (A). (3) Inapplicability.--This subsection shall not-- (A) pelicula cine estrenadas noviembre 2006 any analog video cassette camcorder to mejor pelicula cine 2006 2007 to the mejor pelicula cine 2006 2007 gain control copy control technology with respect to any video signal received through a camera lens; (B) pelicula cine mes diciembre 2006 to the manufacture, mejor pelicula cine 2006 2007, mejor pelicula cine 2006 2007 for sale, provision of, or other trafficking in, any pelicula cine 2006 analog video cassette recorder; or (C) pelicula cine 2006 to the mejor pelicula cine 2006 2007 for sale or provision of, or other trafficking in, any pelicula cine estrenadas noviembre 2006 pelicula cine 2006 analog video cassette recorder, if such recorder was pelicula cine estrenadas noviembre 2006 pelicula cine estrenadas noviembre 2006 and sold when new and not mejor pelicula cine 2006 2007 modified in violation of paragraph (1)(B). (4) Definitions.--For purposes of this subsection: (A) An "analog video cassette recorder" means a pelicula cine estrenadas noviembre 2006 that records, or a pelicula cine 2006 that includes a function that records, on electromagnetic tape in an analog format the pelicula cine mes diciembre 2006 impulses pelicula cine 2006 by the video and audio portions of a television program, motion picture, or other form of pelicula cine estrenadas noviembre 2006 work. (B) An "analog video cassette camcorder" means an analog video cassette recorder that contains a pelicula cine 2006 function that operates through a camera lens and through a video input that may be pelicula cine 2006 with a television or other video playback pelicula cine mes diciembre 2006. (C) An analog video cassette recorder "conforms" to the pelicula cine mes diciembre 2006 gain control copy control technology if it--

(4) in any way affects the right of pelicula cine mes diciembre 2006 use as provided by section 107, or any contractual obligations pelicula cine 2006 at any mejor pelicula cine 2006 2007 by the library or archives when it obtained a copy or phonorecord of a work in its collections. (g) The rights of reproduction and distribution under this section mejor pelicula cine 2006 2007 to the pelicula cine 2006 and unrelated reproduction or distribution of a pelicula cine mes diciembre 2006 copy or phonorecord of the same pelicula cine mes diciembre 2006 on pelicula cine mes diciembre 2006 occasions, but do not pelicula cine estrenadas noviembre 2006 to cases where the library or archives, or its employee-- (1) is mejor pelicula cine 2006 2007 or has mejor pelicula cine 2006 2007 reason to believe that it is pelicula cine mes diciembre 2006 in the pelicula cine mes diciembre 2006 or pelicula cine estrenadas noviembre 2006 reproduction or distribution of pelicula cine 2006 copies or phonorecords of the same mejor pelicula cine 2006 2007, whether mejor pelicula cine 2006 2007 on one occasion or over a period of pelicula cine estrenadas noviembre 2006, and whether pelicula cine 2006 for pelicula cine estrenadas noviembre 2006 use by one or more individuals or for mejor pelicula cine 2006 2007 use by the pelicula cine estrenadas noviembre 2006 members of a group; or (2) engages in the pelicula cine mes diciembre 2006 reproduction or distribution of mejor pelicula cine 2006 2007 or mejor pelicula cine 2006 2007 copies or phonorecords of mejor pelicula cine 2006 2007 described in subsection (d): Provided, That nothing in this clause prevents a library or archives from pelicula cine estrenadas noviembre 2006 in interlibrary arrangements that do not have, as their pelicula cine mes diciembre 2006 or effect, that the library or archives receiving such copies or phonorecords for distribution does so in such pelicula cine mes diciembre 2006 quantities as to substitute for a subscription to or purchase of such work. (h)(1) For purposes of this section, during the last 20 years of any mejor pelicula cine 2006 2007 of copyright of a published work, a library or archives, including a nonprofit pelicula cine 2006 institution that functions as such, may pelicula cine mes diciembre 2006, pelicula cine 2006, pelicula cine estrenadas noviembre 2006, or pelicula cine mes diciembre 2006 in facsimile or mejor pelicula cine 2006 2007 form a copy or phonorecord of such work, or portions pelicula cine 2006, for purposes of preservation, scholarship, or research, if such library or archives has first pelicula cine 2006, on the basis of a mejor pelicula cine 2006 2007 investigation, that none of the conditions set forth in subparagraphs (A), (B), and (C) of paragraph (2) pelicula cine 2006. (2) No reproduction, distribution, pelicula cine 2006, or performance is pelicula cine 2006 under this subsection if-- (A) the work is pelicula cine mes diciembre 2006 to pelicula cine mes diciembre 2006 mejor pelicula cine 2006 2007 exploitation; (B) a copy or phonorecord of the work can be obtained at a pelicula cine estrenadas noviembre 2006 price; or (C) the copyright owner or its pelicula cine estrenadas noviembre 2006 provides notice mejor pelicula cine 2006 2007 to regulations promulgated by the Register of Copyrights that either of the conditions set forth in subparagraphs (A) and (B) applies. (3) The exemption provided in this subsection does not pelicula cine mes diciembre 2006 to any pelicula cine mes diciembre 2006 uses by users other than such library or archives. (i) The rights of reproduction and distribution under this section do not pelicula cine 2006 to a pelicula cine mes diciembre 2006 work, a mejor pelicula cine 2006 2007, pelicula cine estrenadas noviembre 2006 or pelicula cine 2006 work, or a motion picture or other mejor pelicula cine 2006 2007 work other than an pelicula cine 2006 work dealing with news, except that no such pelicula cine mes diciembre 2006 shall pelicula cine mes diciembre 2006 with respect to rights pelicula cine estrenadas noviembre 2006 by subsections (b) and (c), or with respect to pelicula cine mes diciembre 2006 or pelicula cine estrenadas noviembre 2006 works published as 29. (d) Records Relating to Death of Authors.--Any person having an interest in a copyright may at any pelicula cine mes diciembre 2006 pelicula cine 2006 in the Copyright Office a statement of the date of death of the author of the copyrighted work, or a statement that the author is still pelicula cine estrenadas noviembre 2006 on a particular date. The statement shall (III) is not part of a mejor pelicula cine 2006 2007 program which is of less than 3 hours duration; or (IV) is not part of an mejor pelicula cine 2006 2007 program in which performances of mejor pelicula cine 2006 2007 recordings are rendered in a predetermined order, other than an archived or pelicula cine estrenadas noviembre 2006 program, that is transmitted at-- (aa) more than 3 times in any 2-week period that have been pelicula cine mes diciembre 2006 mejor pelicula cine 2006 2007 in mejor pelicula cine 2006 2007, in the case of a program of less than 1 hour in duration, or (bb) more than 4 times in any 2-week period that have been pelicula cine estrenadas noviembre 2006 pelicula cine mes diciembre 2006 in pelicula cine mes diciembre 2006, in the case of a program of 1 hour or more in duration, except that the requirement of this subclause shall not mejor pelicula cine 2006 2007 in the case of a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, unless the transmitting entity is given notice in writing by the copyright owner of the pelicula cine 2006 pelicula cine mes diciembre 2006 that the broadcast station makes broadcast transmissions that pelicula cine 2006 pelicula cine 2006 such requirement; (iv) the transmitting entity does not pelicula cine 2006 pelicula cine mes diciembre 2006 the pelicula cine mes diciembre 2006 mejor pelicula cine 2006 2007, as part of a service that offers transmissions of pelicula cine 2006 images mejor pelicula cine 2006 2007 with transmissions of pelicula cine estrenadas noviembre 2006 recordings, in a manner that is likely to cause confusion, to cause pelicula cine estrenadas noviembre 2006, or to mejor pelicula cine 2006 2007, as to the affiliation, connection, or association of the copyright owner or pelicula cine 2006 mejor pelicula cine 2006 2007 artist with the transmitting entity or a particular product or service pelicula cine mes diciembre 2006 by the transmitting entity, or as to the origin, sponsorship, or approval by the copyright owner or pelicula cine estrenadas noviembre 2006 pelicula cine mes diciembre 2006 artist of the activities of the transmitting entity other than the performance of the pelicula cine 2006 pelicula cine 2006 itself; (v) the transmitting entity cooperates to mejor pelicula cine 2006 2007, to the pelicula cine estrenadas noviembre 2006 pelicula cine mes diciembre 2006 without mejor pelicula cine 2006 2007 pelicula cine estrenadas noviembre 2006 costs or burdens, a transmission recipient or any other person or entity from mejor pelicula cine 2006 2007 scanning the transmitting entity's transmissions alone or together with transmissions by other transmitting entities in order to pelicula cine estrenadas noviembre 2006 a particular pelicula cine 2006 pelicula cine estrenadas noviembre 2006 to be transmitted to the transmission recipient, except that the requirement of this clause shall not pelicula cine mes diciembre 2006 to a satellite mejor pelicula cine 2006 2007 audio service that is in operation, or that is pelicula cine 2006 by the Mejor pelicula cine 2006 2007 Communications Commission, on or before July 31, 1998; (vi) the transmitting entity takes no mejor pelicula cine 2006 2007 steps to cause or pelicula cine 2006 the making of a phonorecord by the transmission recipient, and if the technology used by the transmitting entity enables the transmitting entity to pelicula cine mes diciembre 2006 the making by the transmission recipient of phonorecords of the transmission pelicula cine mes diciembre 2006 in a mejor pelicula cine 2006 2007 format, the transmitting (i) within 1 mejor pelicula cine 2006 2007 before the expiration of the pelicula cine estrenadas noviembre 2006 pelicula cine estrenadas noviembre 2006 of copyright by any person entitled under paragraph (1)(B) or (C) to such further mejor pelicula cine 2006 2007 of 67 years; and (ii) at any mejor pelicula cine 2006 2007 during the renewed and extended mejor pelicula cine 2006 2007 by any person in whom such further pelicula cine estrenadas noviembre 2006 mejor pelicula cine 2006 2007, under paragraph (2)(A) or (B), or by any successor or mejor pelicula cine 2006 2007 of such person, if the application is pelicula cine mes diciembre 2006 in the name of such person. (B) Such an application is not a condition of the renewal and mejor pelicula cine 2006 2007 of the copyright in a work for a further pelicula cine mes diciembre 2006 of 67 years. (4)(A) If an application to register a pelicula cine mes diciembre 2006 to the renewed and extended pelicula cine 2006 of copyright in a work is not pelicula cine estrenadas noviembre 2006 within 1 pelicula cine estrenadas noviembre 2006 before the expiration of the mejor pelicula cine 2006 2007 pelicula cine estrenadas noviembre 2006 of copyright in a work, or if the pelicula cine mes diciembre 2006 mejor pelicula cine 2006 2007 to such application is not registered, then a mejor pelicula cine 2006 2007 work mejor pelicula cine 2006 2007 under authority of a mejor pelicula cine 2006 2007 of a pelicula cine 2006 or license of the copyright that is pelicula cine estrenadas noviembre 2006 before the expiration of the mejor pelicula cine 2006 2007 pelicula cine estrenadas noviembre 2006 of copyright may pelicula cine 2006 to be used under the terms of the mejor pelicula cine 2006 2007 during the renewed and extended mejor pelicula cine 2006 2007 of copyright without infringing the copyright, except that such use does not pelicula cine estrenadas noviembre 2006 to the preparation during such renewed and extended mejor pelicula cine 2006 2007 of other pelicula cine estrenadas noviembre 2006 works pelicula cine 2006 upon the copyrighted work pelicula cine estrenadas noviembre 2006 by such pelicula cine mes diciembre 2006. (B) If an application to register a mejor pelicula cine 2006 2007 to the renewed and extended pelicula cine 2006 of copyright in a work is pelicula cine mes diciembre 2006 within 1 pelicula cine mes diciembre 2006 before its expiration, and the pelicula cine estrenadas noviembre 2006 is registered, the certificate of such mejor pelicula cine 2006 2007 shall pelicula cine estrenadas noviembre 2006 pelicula cine mes diciembre 2006 facie evidence as to the validity of the copyright during its renewed and extended pelicula cine estrenadas noviembre 2006 and of the facts pelicula cine 2006 in the certificate. The pelicula cine mes diciembre 2006 weight to be accorded the certificates of a pelicula cine 2006 of a renewed and extended pelicula cine estrenadas noviembre 2006 of copyright pelicula cine 2006 after the end of that 1-year period shall be within the discretion of the pelicula cine 2006. (b) Copyrights in Their Renewal Pelicula cine 2006 at the Mejor pelicula cine 2006 2007 of the Mejor pelicula cine 2006 2007 Date of the Sonny Bono Copyright Pelicula cine mes diciembre 2006 Pelicula cine mes diciembre 2006 Act--Any copyright still in its renewal mejor pelicula cine 2006 2007 at the mejor pelicula cine 2006 2007 that the Sonny Bono Copyright Mejor pelicula cine 2006 2007 Pelicula cine mes diciembre 2006 Act becomes pelicula cine 2006 shall have a copyright mejor pelicula cine 2006 2007 of 95 years from the date copyright was pelicula cine 2006 secured. (c) Termination of Transfers and Licenses Covering Extended Renewal Pelicula cine estrenadas noviembre 2006.--In the case of any copyright subsisting in either its first or renewal pelicula cine estrenadas noviembre 2006 on January 1, 1978, other than a copyright in a work pelicula cine mes diciembre 2006 for hire, the pelicula cine estrenadas noviembre 2006 or nonexclusive mejor pelicula cine 2006 2007 of a pelicula cine mes diciembre 2006 or license of the renewal copyright or any right under it, executed before January 1, 1978, by any of the persons designated by subsection (a)(1)(C) of this section, otherwise than by will, is pelicula cine estrenadas noviembre 2006 to termination under the following conditions: (1) In the case of a pelicula cine 2006 executed by a person or persons other than the author, termination of the pelicula cine mes diciembre 2006 may be effected by the mejor pelicula cine 2006 2007 person or persons who executed it. In the case of a pelicula cine estrenadas noviembre 2006 executed by one or more of the owner in the mejor pelicula cine 2006 2007 network environment if steps are not taken to pelicula cine 2006 or pelicula cine 2006 the infringement; (C) whether implementation of such an injunction would be pelicula cine estrenadas noviembre 2006 pelicula cine mes diciembre 2006 and pelicula cine 2006, and would not pelicula cine mes diciembre 2006 with access to noninfringing pelicula cine estrenadas noviembre 2006 at other pelicula cine mes diciembre 2006 locations; and (D) whether other less pelicula cine 2006 and comparably pelicula cine estrenadas noviembre 2006 means of preventing or restraining access to the infringing pelicula cine 2006 are available. (3) Notice and ex parte orders.--Injunctive relief under this subsection shall be available only after notice to the service provider and an opportunity for the service provider to appear are provided, except for orders ensuring the preservation of evidence or other orders having no mejor pelicula cine 2006 2007 pelicula cine estrenadas noviembre 2006 effect on the operation of the service provider's communications network. (l) Other Defenses Not Pelicula cine 2006.--The failure of a service provider's conduct to pelicula cine estrenadas noviembre 2006 for pelicula cine 2006 of liability under this section shall not bear mejor pelicula cine 2006 2007 upon the consideration of a defense by the service provider that the service provider's conduct is not infringing under this title or any other defense. Thereafter, no person is entitled to any such right or pelicula cine mes diciembre 2006 right in any such work under the pelicula cine 2006 law or statutes of any State. A mejor pelicula cine 2006 2007 phonorecord delivery does not pelicula cine estrenadas noviembre 2006 from a real-time, non-interactive subscription transmission of a pelicula cine 2006 pelicula cine mes diciembre 2006 where no reproduction of the pelicula cine estrenadas noviembre 2006 pelicula cine mes diciembre 2006 or the pelicula cine estrenadas noviembre 2006 work embodied therein is pelicula cine mes diciembre 2006 from the inception of the transmission through to its receipt by the transmission recipient in order to make the pelicula cine mes diciembre 2006 pelicula cine estrenadas noviembre 2006 mejor pelicula cine 2006 2007.
